Welcome to Ghar Ka Khana! These Terms and Conditions ("Terms") govern your use of the Ghar Ka Khana mobile application and website (collectively, the "Services") operated by Ghar Ka Khana ("we," "us," or "our").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

1. Acceptance of Terms

By creating an account, placing an order, or using any part of our Services, you acknowledge that:

• You have read, understood, and agree to be bound by these Terms
• You are at least 18 years of age or have parental/guardian consent
• You have the legal capacity to enter into this agreement
• You will comply with all applicable laws and regulations

2. Description of Services

2.1 What We Provide

Ghar Ka Khana is a technology platform that connects customers seeking homemade food with independent home chefs who prepare and sell home-cooked meals. We provide:

• A marketplace to discover and order from local home chefs
• Order processing and tracking functionality
• Secure payment processing through Razorpay
• Customer support services

2.2 What We Are Not

Please understand that:

• We are a technology platform, not a restaurant or food manufacturer
• We facilitate connections between customers and home chefs
• Home chefs are independent service providers, not employees of Ghar Ka Khana
• We do not prepare, cook, or handle the food directly

3. User Accounts

3.1 Account Registration

To use certain features of our Services, you must create an account by providing:

• A valid email address or phone number
• Your full name
• A delivery address
• Other information as required

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Ensuring your account information is accurate and up-to-date

3.3 Account Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms
• Provide false or misleading information
• Engage in fraudulent activities
• Harass home chefs, delivery personnel, or other users

4. Ordering and Payments

4.1 Placing Orders

When you place an order through our platform:

• You are making an offer to purchase food from an independent home chef
• The order is confirmed once accepted by the home chef
• Prices displayed include the food cost; delivery charges and taxes are shown separately
• Order confirmation will be sent via email or push notification

4.2 Payment Processing

All payments are processed securely through Razorpay. We accept:

• UPI payments
• Debit and Credit cards (Visa, Mastercard, RuPay)
• Net Banking
• Digital wallets

By making a payment, you agree to Razorpay's terms of service.

4.3 Pricing

• All prices are displayed in Indian Rupees (INR)
• Prices may include applicable taxes and service charges
• Home chefs may modify prices at their discretion
• Platform/service fees may apply to certain orders

4.4 Delivery Charges

Delivery charges are calculated based on distance and other factors. These charges are displayed before you confirm your order.

5. Order Cancellation and Modifications

5.1 Cancellation by Customer

• Before cooking starts: Full refund may be available
• After cooking starts: Partial or no refund depending on circumstances
• After dispatch: No refund available

5.2 Cancellation by Home Chef

If a home chef cancels your order:

• You will receive a full refund
• We will attempt to suggest alternative options when available
• Refunds will be processed within 5-7 business days

5.3 Order Modifications

Order modifications are subject to the home chef's approval. Once cooking has started, modifications may not be possible.

6. User Responsibilities

As a user of our Services, you agree to:

• Provide accurate delivery information
• Be available to receive orders at the specified delivery time
• Treat home chefs and delivery personnel with respect
• Inform us of any food allergies or dietary restrictions before ordering
• Not misuse the platform for fraudulent purposes

7. Prohibited Activities

You agree not to:

• Place fraudulent or fake orders
• Harass, threaten, or abuse home chefs or delivery personnel
• Use the platform for any illegal purposes
• Attempt to circumvent security measures
• Share your account with others
• Post false reviews or ratings
• Scrape or copy content from our platform
• Interfere with the proper functioning of our Services

8. Intellectual Property

8.1 Our Intellectual Property

The Ghar Ka Khana name, logo, app, website design, and all content are owned by us and protected by intellectual property laws. You may not:

• Copy, modify, or distribute our content without permission
• Use our trademarks without authorization
• Reverse engineer our software applications

8.2 User-Generated Content

By posting reviews, ratings, or photos on our platform, you grant us a non-exclusive, royalty-free license to use, display, and distribute such content for the purposes of operating our Services.

9. Limitation of Liability

9.1 Food Quality and Safety

While we verify home chefs for basic hygiene and quality standards:

• Home chefs are independently responsible for food quality and safety
• We do not guarantee the taste, quality, or suitability of any food
• You acknowledge that home-cooked food may vary from professional restaurant standards

9.2 Platform Limitations

• We are not liable for delays, technical issues, or service interruptions
• We do not guarantee uninterrupted or error-free service
• Our liability is limited to the amount paid for the specific order in question

9.3 Maximum Liability

In no event shall our total liability exceed the greater of: (a) the amount you paid for the order that gave rise to the claim, or (b) INR 1,000.

10. Indemnification

You agree to indemnify and hold harmless Ghar Ka Khana, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:

• Your use of our Services
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit through our platform

11. Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India.

11.2 Jurisdiction

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.

11.3 Informal Resolution

12. Termination

12.1 By You

You may terminate your account at any time by contacting us or using the account deletion feature in the app.

12.2 By Us

We may terminate or suspend your account immediately, without prior notice, for any reason, including but not limited to:

• Breach of these Terms
• Fraudulent activity
• Abuse of platform policies
• Legal requirements

12.3 Effect of Termination

Upon termination:

• Your access to the Services will be revoked
• Any pending orders may be cancelled
• Applicable refunds will be processed per our Refund Policy
• Sections that by their nature should survive will remain in effect

13. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes:

• We will update the "Last Updated" date
• We may notify you via email or in-app notification for significant changes
• Continued use of our Services after changes constitutes acceptance

It is your responsibility to review these Terms periodically.

14. Miscellaneous

14.1 Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Ghar Ka Khana.

14.5 Legal Compliance

Ghar Ka Khana complies with all applicable Indian laws, including the Information Technology Act, 2000, Consumer Protection Act, 2019, and FSSAI regulations for food safety and e-commerce.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

14.3 Waiver

Our failure to enforce any provision of these Terms shall not be deemed a waiver of that provision or any other provision.

14.4 Assignment

You may not assign your rights or obligations under these Terms without our prior written consent.
